Summary
The protection status of bats and its implication in urban landuse planning and licensing procedure
All bats are specially and strictly protected species according to § 10 (2), no. 10 b aa) and no. 11 ofthe Federal law for Nature Protection and to Annex IV ofthe Habitats Directive. Concerning planning and licensing procedures, the interdictions for species protection according to § 42 (1) no. 1 of the Federal Law for Nature Protection are valid. Exemptions can only be made under the strict conditions of § 62 in connection with Art. 16 of the Habitats Directive. Concerning foraging areas ofbats, the interdiction of killing and injury of bats is valid, therefore wind turbines are not allowed in these places. For roosting places (including reproduced roosts) even unintentional disturbance is prohibited.
